Terms of Service

1. What Folio Is

Folio is a portfolio platform that lets professionals showcase their work projects, case studies, and career experience in a shareable, publicly accessible profile, accessible at usefol.io ("the Service"). By creating an account or using Folio, you agree to these Terms of Service ("Terms").

2. Your Account

You must provide accurate information when registering. You are responsible for maintaining the security of your password and for all activity under your account. Notify us immediately at folioinbox@gmail.com if you suspect unauthorized access.

You must be at least 13 years old to use Folio. If you are under 18, you represent that a parent or guardian has reviewed and agrees to these Terms on your behalf.

3. Your Content

You own everything you post to Folio ("Your Content"). By uploading or publishing content, you grant Folio a limited, worldwide, royalty-free license to host, display, and distribute Your Content solely to operate the Service (for example, to render your public portfolio page).

You are solely responsible for Your Content. You represent and warrant that:

  • You have the rights necessary to post it.
  • It does not infringe any third party's intellectual property rights.
  • It does not violate any applicable law.

We may remove content that violates these Terms without notice.

4. Acceptable Use

You agree not to:

  • Upload malware, spam, or illegal content.
  • Attempt to access another user's account or Folio's backend systems.
  • Use Folio to harass, impersonate, or defame others.
  • Scrape or systematically download content from Folio without our written permission.
  • Use automated tools to create accounts in bulk.

5. Plans and Payment

Folio offers a free tier and, when available, paid subscription plans. Paid plan pricing, billing cycles, and included features will be displayed at the time of purchase. Payments are processed by Stripe. By subscribing to a paid plan, you also agree to Stripe's terms.

When paid plans are available:

  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are not issued for partial billing periods, except where required by law.
  • We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance.

6. Intellectual Property

The Folio name, logo, product design, and underlying code are owned by Folio and protected by intellectual property law. Nothing in these Terms transfers any ownership of Folio's IP to you.

7. Termination

You may delete your account at any time from your dashboard settings. We may suspend or terminate your account if you violate these Terms, without liability. Upon termination, your public portfolio will no longer be accessible and your stored files will be deleted within 30 days.

8. Disclaimers

Folio is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.

9. Limitation of Liability

To the maximum extent permitted by law, Folio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Dispute Resolution and Arbitration

Informal Resolution First. Before filing any formal claim, you agree to contact us at folioinbox@gmail.com and give us 30 days to resolve the dispute informally.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Missouri or remotely, at your election. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Small Claims Exception. Either party may bring an individual claim in small claims court instead of arbitration, so long as the claim qualifies and remains in small claims court.

Class Action Waiver. You and Folio each agree to bring claims only in your individual capacities and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims from multiple parties.

Opt-Out. You may opt out of arbitration by emailing folioinbox@gmail.com within 30 days of first creating your account. Your opt-out notice must include your name and the email address associated with your account. If you opt out, all other Terms remain in effect.

11. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Missouri.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the site at least 14 days before they take effect. Continued use of Folio after the effective date means you accept the revised Terms.
